These Terms and Conditions (“Terms”) apply to your use of this website (the Website), operated by The Property Factory 2024 Limited (“The Property Factory”, “we”, “us”, or “our”).
By accessing, browsing, submitting forms on, or otherwise using this Website, you agree to be bound by these Terms. If you do not agree, you must not use the Website.

The Property Factory 2024 Limited is a licensed real estate agency under the Real Estate Agents Act 2008 (New Zealand).
The Website provides general information about property opportunities, services, and related content for a broad audience, including investors, first-home buyers, developers, and real estate professionals.

You agree that you will:

14. Dispute Resolution
If a dispute arises, the parties agree to first attempt to resolve it through good-faith negotiation and mediation.
If unresolved, the dispute may be referred to the courts of New Zealand.
15. Governing Law
These Terms are governed by the laws of New Zealand, and New Zealand courts have exclusive jurisdiction.
16. General
If any provision is unenforceable, the remaining provisions remain in effect.
These Terms constitute the entire agreement relating to Website use.
17. Client Referral Programme
These terms apply to all referrals submitted through The Property Factory's referral programme.
17.1. The Property Factory Limited ("we", "us", "our") rewards people who introduce prospective property purchasers to us. If a person you refer goes on to purchase a property through The Property Factory, we will send you a $500 Prezzy card as a thank-you, subject to these terms. By submitting a referral, you accept these terms.
17.2. Anyone aged 18 or over can refer, whether or not they have previously purchased through The Property Factory.
17.3. The Property Factory's directors, employees, and contractors, and members of their immediate households, are not eligible for referral rewards.
17.4. The programme is for personal referrals. It is not a commercial arrangement, and The Property Factory may decline referrals from any person operating a systematic or commercial referral activity. Licensed real estate professionals are not eligible for rewards under this programme.
17.5. A referral qualifies when all of the following are true:
- (a) The referral was submitted through The Property Factory's referral form before The Property Factory's first contact with the referred person about their purchase;
- (b) The referred person is a genuine new introduction to our sales team — meaning that, at the time of the referral, they do not have an open enquiry with The Property Factory, an assigned salesperson at The Property Factory, or a purchase in progress with The Property Factory. Being subscribed to a mailing list of The Property Factory, or having enquired with The Property Factory in the past about a matter that is now closed, does not disqualify a referral;
- (c) The referred person is aware their details are being shared with The Property Factory and has agreed to be contacted;
- (d) The referred person subsequently enters into an agreement to purchase a property through The Property Factory as selling agency, and that agreement goes unconditional within 12 months of the referral being submitted; and
- (e) The referred person is not the referrer, and is not purchasing the property jointly with the referrer.
17.6. If more than one person refers the same referred person, the reward goes to the first valid referral received, determined by the form submission timestamp.
17.7. One reward is payable per referred person, based on their first qualifying purchase, regardless of how many properties that person goes on to buy.
17.8. There is no limit on the number of people you can refer. Each separate referred person who meets these terms earns a separate $500 reward.
17.9. The reward is a $500 Prezzy card (or a substitute reward of equivalent value if Prezzy cards are unavailable). Prezzy cards are subject to the card issuer's own terms, including any expiry.
17.10. The reward is sent within 14 days of the referred person's purchase going unconditional, using the contact details you provided on the referral form.
17.11. Rewards are not transferable and cannot be exchanged for cash. Any tax obligations arising from a reward are the referrer's responsibility.
17.12. Your role as referrer is limited to introducing the referred person to The Property Factory. You must not negotiate, present offers, show properties, or otherwise carry out real estate agency work on The Property Factory's behalf.
17.13. You must not send unsolicited bulk messages, publish advertising, or make representations on The Property Factory's behalf when referring. Referrals generated this way may be declined.
17.14. You confirm that the information you submit is accurate and that you have the referred person's permission to share their details with us. The Property Factory will mention your name when first contacting the referred person.
17.15. Personal information collected through the referral form is used to process the referral, contact the referred person about their property search, and administer rewards, in accordance with the Privacy Act 2020 and The Property Factory's privacy policy.
17.16. Whether a referral qualifies under these terms is determined by The Property Factory, acting reasonably, and The Property Factory's determination is final. The Property Factory may decline any referral that it reasonably considers is not a genuine introduction or does not comply with these terms.
17.17. The Property Factory may amend, suspend, or end the programme at any time. Referrals validly submitted before any change will be honoured under the terms in force at the time of submission.
17.18. If a referred person's purchase is cancelled after going unconditional, any reward already paid is yours to keep; no further reward is payable in respect of that referred person.
